Terms of Service

By accessing or using DashDine ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms apply to all visitors, restaurant operators, and their customers.

DashDine provides a cloud-based restaurant management platform including QR code menus, online ordering, a kitchen display system (KDS), multi-branch management, staff tools, and analytics. We reserve the right to modify or discontinue features with reasonable notice.

You must:

• Provide accurate, complete, and current information during registration.
• Keep your login credentials confidential and not share them.
• Notify us immediately at support@dashdinemenu.com of any unauthorised access.
• Accept responsibility for all activity under your account.
• Be at least 18 years old (or the legal age of majority in your jurisdiction).

Paid subscriptions are billed monthly or annually in advance. All fees are in USD unless a localised price is displayed. Fees are non-refundable except as required by applicable law or where expressly stated.

If payment fails, we will notify you and may suspend your account after a reasonable grace period. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period.

We process payments via Stripe. Your use of Stripe is subject to Stripe's terms.

The free plan is limited to 50 orders per month and one location. We may modify free plan limits with 30 days' notice. Trial periods (where offered) convert to a paid subscription at the end of the trial unless cancelled.

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose.
• Upload or transmit malware, spam, or abusive content.
• Attempt to gain unauthorised access to our systems or another user's data.
• Reverse-engineer, decompile, or copy the Service or its source code.
• Resell or sublicense the Service without our written consent.
• Interfere with the integrity or performance of the Service.

We may suspend or terminate accounts that violate this section without notice.

You retain ownership of all content you upload to the Service (menus, photos, descriptions). By uploading content, you grant DashDine a limited, worldwide, non-exclusive licence to host, display, and process it solely to provide the Service.

You are responsible for ensuring you have the rights to upload content and that it does not infringe any third-party intellectual property rights.

The DashDine platform, name, logo, design, and all underlying code are owned by DashDine, Inc. and protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our intellectual property other than to use the Service as permitted herein.

Our Privacy Policy describes how we collect and use your data. By using the Service you also agree to the Privacy Policy. For data processing under GDPR, we act as a data processor for your customer data and a data controller for your account data.

We work to keep the Service available and reliable. Planned maintenance is announced in advance. In the event of extended unplanned downtime (> 24 hours), Pro plan customers may request a pro-rated service credit. Credits are the sole remedy for downtime events.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

To the maximum extent permitted by law, DashDine shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless DashDine, its officers, directors, employees, and agents from any claims, damages, and expenses (including legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

You may cancel your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or for any other reason with reasonable notice. On termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute shall first be submitted to good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the AAA Commercial Arbitration Rules. You waive any right to a jury trial or class action.

We may update these Terms and will notify you by email and/or in-app notice at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
